⚠️ Important Notice: This Cancellation and Refund Policy applies to all customers subscribing to TMBill services. Please read this policy carefully to understand your rights and our refund procedures.

Introduction

We, TMBill ("We", "Us", "Our", "Company"), provide a cloud-based point of sales software application for restaurants together with optionally integrated services such as mobile or card payments, inventory management, reporting and analytics, customer management, and other services using a programmable API architecture.

The Company through such point of sale software application and websites (together referred to as "TMBill Platforms") also provides end-to-end integration of services for restaurant management to various restaurants and food outlets. The Company has created and owns the TMBill Platforms and licensed the use of the same by way of various subscription models for a Subscription Fee.

The subscription to the TMBill POS Platform and other value-added services ("TMBill Subscription") offered by us is subject to our Terms of Services that is agreed by you (or anyone who accesses and uses the TMBill Platforms shall be referred to as "You", "Your" or "User" as the context may require) at the time of subscription.

You are required to pay subscription fee as per the TMBill Subscription plan subscribed by you ("Subscription Fee").

The Subscription Fee for TMBill Subscription as stated in various subscription plans is generally non-refundable, and no refunds are eligible except as expressly set forth in this Cancellation & Refund Policy.

How to Cancel

📧 Cancellation Process: You may cancel your paid TMBill Subscription any time by:

  • Visiting Your Account and adjusting your subscription settings on any of the TMBill Platforms
  • Contacting our support team at support@tmbill.com
  • Calling our customer service helpline

Annual Subscription Refund Policy

📅 Annual Plan Refund Timeline

Within 15 Business Days:

If you cancel within 15 business days of signing up, we will issue a credit note and refund your full Subscription Fee. However, we may charge you (or withhold from your refund) the value of TMBill benefits used by you during this 15 business day period by issuing a partial credit note.

After 15 Business Days:

If you cancel at any other time, we will raise a credit note and refund your Subscription Fee only to the extent of your usage of the subscription plan since the payment of the Subscription Fee. The refund will be calculated on a pro-rated basis.

Processing Time:

It will take up to 30 days to process a refund to be credited to your bank account from the date of approval.

Monthly Subscription Refund Policy

📝 Monthly Plan Conditions:

If you cancel the monthly TMBill Subscription, the subscription fee will be refunded only if you have not made any usage or taken advantage of any of the TMBill benefits since payment of your Subscription Fee.

Processing time: It will take up to 30 days to process a refund to be credited to your bank account.

Calculation of Usage-Based Refunds

For pro-rated refunds, usage is calculated based on:

Non-Refundable Items

⚠️ The following are NOT eligible for refunds:

  • Monthly subscriptions where any service has been used
  • Transaction fees or payment processing charges
  • Third-party service fees (e.g., SMS charges, payment gateway fees)
  • Add-on services that have been activated or used
  • Custom development or integration work
  • Training or onboarding services already provided
  • Hardware purchases (unless defective and within warranty period)

Refund Method

Credit Notes

All refunds are processed through credit notes. A credit note will be issued to you before the refund is processed to your account.

Refunds will be credited to the same payment method used for the original purchase:

Termination by TMBill

Our Right to Terminate

We may terminate your TMBill Subscription at our discretion without notice. If we do so, we will issue a credit note to you and give a prorated refund based on the remaining term of your subscription, whether annual or monthly.

Exceptions to Refund

⛔ No refund will be provided for termination related to:

  • Conduct that violates the Terms of Service
  • Violation of any applicable law
  • Fraud or misuse of the TMBill Subscription
  • Activities harmful to our interests or another user
  • Abuse of the platform or services
  • Repeated violations of our policies

Right to Enforce Terms

Our failure to insist upon or enforce your strict compliance with the Terms of Services or this Cancellation & Refund Policy will not constitute a waiver of any of our rights.

Policy Revisions

We may in our discretion change the Terms of Service as well as this Cancellation & Refund Policy, or any aspect of TMBill Subscription, without notice to you.

If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions.

⚠️ IMPORTANT: YOUR CONTINUED SUBSCRIPTION AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR SUBSCRIPTION.

IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN OUR TERMS OF SERVICE, IN NO EVENT WILL WE OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO TMBILL PLATFORMS.

OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST SUBSCRIPTION FEE YOU PAID.

THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR TMBILL SUBSCRIPTION.
